Financial Incentives for Brownfield Redevelopment
- Properties located in NYS’s Brownfield Opportunity Areas benefit from an established community vision and realistic strategy for revitalization. BOA funds may be secured for environmental site assessments and remedial strategies when needed; Generic Environmental Impact Statement, and a host of pre-development activities, including site renderings to illustrate redevelopment potential, analysis of project feasibility and use and design alternatives, and due diligence. Brownfield Opportunity Areas also benefit by an increased competitiveness for other funding programs.
- Properties located adjacent to coastal or inland waterways may benefit from New York State’s Environmental Protection Fund Local Waterfront Revitalization Program (LWRP), and implementation projects sponsored by local municipalities. LWRPs are locally prepared, comprehensive land and water use plans for a community’s waterfront area. Funding may be available for eligible local governments to implement key public improvement projects that foster economic development.
- Taxpayers entering into a Brownfield Cleanup Agreement (BCA) with the New York State Department of Environmental Conservation may be eligible for tax credits relating to the cleanup and redevelopment of brownfield sites. Projects accepted into the BCP may qualify for credits ranging from 22-50% for site preparation and on-site ground remediation, and 10-24% of eligible costs for tangible property (Redevelopment Credit). Tangible property credits are enhanced by 2% for properties located in designated BOA’s, and are subject to a cap.
State and Local Programs
The goal of the Brownfield Cleanup Program (BCP) is to enhance private-sector cleanups of brownfields and to reduce development pressure on "greenfields"
Under the Brownfield Opportunity Areas (BOA) Program, the New York State Department of State (DOS) provides financial and technical assistance to municipalities and community-based organizations. Funding can be used to complete revitalization plans and implementation strategies for areas affected by the presence of brownfield sites, as well as site assessments for strategic sites.

In an effort to spur the cleanup and redevelopment of brownfields, New Yorkers approved a $200 million Environmental Restoration Fund as part of the $1.75 billion Clean Water/Clean Air Bond Act of 1996 (Bond Act). Under the Environmental Restoration Program, the State provides grants to municipalities to reimburse up to 90 percent of on-site eligible costs and 100% of off-site eligible costs for site investigation and remediation activities. Once remediated, the property may then be reused for commercial, industrial, residential or public use.
